Don't Overlook the Importance of Complying with Notice Requirements During This Crisis

The COVID-19 coronavirus has led to multiple regulations restricting and in some cases shutting down commerce.  While you should immediately attend to health concerns and compliance with these regulations you should also be mindful of the Notice provisions in your contracts.  Maybe you have a “force majeure” clause in your contract that relieves the parties from performing their contractual obligations in certain circumstances.

Whether an outbreak like the COVID-19 coronavirus qualifies as “force majeure” involves a case by case analysis.  What you don’t want to happen though is be precluded because you failed to give notice.   If you need help don’t hesitate to call on us.
