The construction industry is risky enough without the increased risks resulting from careless or uninformed contract formation practices. Many construction projects do not end up in dispute. On such untroubled projects, the allocation of risks and responsibilities in the contract documents receives little, if any, attention by the parties. However, this is not always the case. When disputes and controversies do arise, the resolution of such problems generally begin (and often end, as well) with the terms and conditions contained in the contract documents.

This seminar is designed for both prime contractors and subcontractors and will highlight common “killer” contract clauses that can be potentially very damaging to your business. The seminar will also offer suggestions on how to make changes in these killer clauses to lesson your risk on a project. Areas to be covered by our panel of construction attorneys include:

Conflicts and Ambiguities in the Contract Documents * Incorporation by Reference Clauses
Vague or Open-Ended Scope of Work * Delegation of Design Responsibility
No Damages for Delay Clauses * Contingent Payment Clauses * Retainage Provisions
Stop Work Provisions * Changes & Extra Work * Waiver Provisions * Indemnification Clauses
Additional Insured Provisions * Contract Termination Provisions * Dispute Resolution Provisions
