The construction industry is risky enough without the increased risks resulting from careless or uninformed contract formation practices.  Many construction projects do not end up in dispute.  On such untroubled projects, the allocation of risks and responsibilities in the contract documents receives little, if any, attention by the parties.  However, this is not always the case.  When disputes and controversies do arise, the resolution of such problems generally begin (and often end, as well) with the terms and conditions contained in the contract documents.

Beginning on January 19, 2021, NESCA will be hosting a weekly series of eight webinars on “Killer Contract Clauses” instructed by eight of the best construction attorneys in upstate New York.  This webinar series is designed for both prime contractors and subcontractors and will highlight common “killer” contract clauses that can be potentially very damaging to your business.  These webinars will also offer suggestions on how to make changes to these killer clauses to lesson your risk on a project.  Each week will feature a different attorney who will cover several important contract provisions.  Provisions to be covered during the entire series include payment provisions, changes and extra work, waiver provisions, conflicts and ambiguities, notice and recordkeeping provisions, indemnification provisions and much more.  Individual registration forms for each webinar in the series will be emailed to all members.
